PRIVACY POLICY — Silva Growth

This Privacy Policy describes how Silva Growth LLC, a Massachusetts limited liability company ("Silva Growth," "we," "us"), collects, uses, and shares personal information when you visit silvagrowth.com, use our client portal, or purchase our services. A Portuguese version of this policy is available at /privacidade; in case of conflict, this English version controls.

1. Information We Collect

  • Contact and account information: name, business name, email address, phone number, mailing address, portal login credentials, and communication preferences (including preferred language).
  • Billing information: payment card details are collected and stored by our payment processor, not on our servers. We receive and keep billing history, invoices, and payment status.
  • Order and service information: the services you purchase, domain names we administer for you, website content and materials you provide, and support communications.
  • Usage information collected automatically: IP address, browser and device type, pages visited, and referring pages, collected through cookies and similar technologies (see Section 5).
  • Consent records: when you accept our terms or authorize recurring billing, we record the acceptance (name, timestamp, IP address, and the version of the terms accepted), as required by law.

2. How We Use Information

We use personal information to: provide, maintain, and bill the services you ordered; administer domains registered on your behalf; send transactional notices required by law (renewal reminders, billing notices, cancellation confirmations); respond to support requests in your preferred language; improve our website and services; prevent fraud and abuse; and comply with legal obligations.

3. How We Share Information

We do not sell personal information, and we do not share it for cross-context behavioral advertising. We share personal information only with:

  • Service providers acting on our behalf, under contractual confidentiality duties, in these categories: hosting and infrastructure providers; domain registrars and registries; payment processors; e-mail and communication providers; print and fulfillment vendors (for physical brand kits); and analytics providers.
  • Domain registration authorities: if we register a domain for you, your contact data may be provided to the registrar, registry, and ICANN as required by domain-registration policies, and may be disclosed to third parties presenting reasonable evidence of actionable harm, as described in our services agreement.
  • Professional advisers and authorities where required to comply with law, enforce our agreements, or protect rights, safety, and property.
  • A successor entity in connection with a merger, acquisition, or sale of our business, subject to this policy.

4. Third-Party Collection on Our Site

Our website uses Google Analytics, a web analytics service provided by Google LLC, and the Meta Pixel, an advertising measurement tool provided by Meta Platforms, Inc. These tools use cookies and similar technologies to collect information about your visits to our site over time and, in the case of advertising tools, across different websites, to help us measure site usage and advertising performance. Google and Meta process this information under their own privacy policies. You can opt out of Google Analytics with the browser add-on at https://tools.google.com/dlpage/gaoptout, manage Google ad settings at https://adssettings.google.com, and manage Meta ad preferences at https://www.facebook.com/adpreferences — or block these cookies in your browser. We do not currently respond to browser "Do Not Track" signals, because there is no common industry standard for them.

5. Cookies

We use essential cookies (login sessions, checkout) and analytics cookies (site usage statistics). You can block or delete cookies in your browser settings; essential features such as the client portal may not work without them.

6. Where Data Is Processed; International Transfers

We are a US company and our team may operate from the United States and Brazil. Your information may be processed in both countries. Where processing occurs in Brazil, it is subject to the Brazilian General Data Protection Law (LGPD — Lei 13.709/2018); cross-border transfers from Brazil follow ANPD-approved mechanisms.

7. Your Rights and Choices

  • Access, correction, deletion: you may request a copy of your personal information, ask us to correct it, or ask us to delete information we are not legally required to keep, by emailing hello@silvagrowth.com. We respond within 30 days.
  • Marketing: transactional messages (billing, renewals, legal notices) are required for the service, but you may opt out of promotional messages at any time via the unsubscribe link or by email.
  • California residents: we post this policy in compliance with the California Online Privacy Protection Act (CalOPPA). If you have questions about the categories of information collected or shared, contact us at the address below.
  • LGPD (Brazil): if your data is processed in Brazil, you have the rights set out in LGPD art. 18 (confirmation, access, correction, anonymization, portability, deletion, information about sharing, and revocation of consent). 8. Retention and Security

We keep personal information for as long as needed to provide the services, meet legal and tax obligations (typically up to 7 years for billing records and at least 3 years for consent records), and resolve disputes, after which it is deleted or anonymized. We use reasonable technical and organizational safeguards (encryption in transit, access controls, reputable infrastructure providers); no method of transmission or storage is 100% secure.

9. Children

Our services are for businesses and are not directed to children under 13. We do not knowingly collect information from children.

10. Client Website Visitors

We build and host websites for our clients. Data submitted by visitors of a client's website (for example, through a contact form) belongs to that client and is governed by that client's own privacy practices; we process it only as the client's service provider.

11. Changes to This Policy

If we make material changes, we will update the "Effective date" above and notify active clients by email or portal notice before the change takes effect. Prior versions are available on request.
